FanPredikt Terms of Service

By using FanPredikt, you represent that you meet these requirements and, if you are under 18, that a parent or guardian has approved your use of the Services.

FanPredikt is a free-to-play prediction platform. There is no cost to join or play, and FanPredikt never collects, processes, or stores payment card numbers, banking details, or any other financial account information — there's nothing to purchase, so there's nothing financial to collect.

Within the Services, you may be able to make predictions, earn virtual points or in-platform currency, appear on leaderboards or rankings, and, where offered, participate in reward programs that let you redeem points for prizes. None of this involves real-money wagering, and virtual points or currency have no cash value and cannot be purchased, sold, transferred, or exchanged for cash except as expressly permitted through a reward program we offer.

To use most features of the Services, you'll need to create an account using an email address and password. You agree to:

1. 01Provide accurate information when creating and maintaining your account;
2. 02Keep your login credentials confidential and secure;
3. 03Notify us promptly at admin@fanpredikt.com if you suspect unauthorized access to your account; and
4. 04Maintain only one account per person.

You're responsible for all activity that occurs under your account. FanPredikt is not liable for any loss or damage arising from your failure to safeguard your account credentials.

Where FanPredikt offers virtual points, in-platform currency, leaderboards, rankings, or reward programs:

1. 01Points and currency are for entertainment purposes within the Services and are not property, do not accrue interest, and have no cash value, except where a specific reward program expressly allows redemption for prizes.
2. 02Leaderboards and rankings reflect activity within the Services and may be reset, adjusted, or removed by FanPredikt at any time, including to correct errors or address suspected cheating or abuse.
3. 03Any prizes or rewards offered through a reward program are subject to additional eligibility requirements, availability, and rules that we may publish for that specific program, and FanPredikt may modify, suspend, or discontinue any reward program at any time.
4. 04FanPredikt may adjust, reverse, or remove points or rewards obtained through error, fraud, or violation of these Terms.

Ownership

The Services and everything made available through them — including odds, probabilities, predictions, market and event data, rankings, statistics, graphics, text, software, and other materials (collectively, "FanPredikt Data") — are owned by or licensed to FanPredikt and protected by copyright, trademark, and other intellectual property laws worldwide. FanPredikt Data may be developed using proprietary methods, and all rights, title, and interest in it are reserved to FanPredikt. Nothing in these Terms transfers any ownership rights to you.

Permitted Use

You may access and use FanPredikt Data solely as it is presented within the Services, for your own personal, non-commercial use. Your use of the Services and FanPredikt Data is at your own risk, and FanPredikt Data is provided "as is" without any warranty as to its accuracy, completeness, or timeliness. FanPredikt Data should be treated as informational only and should not be relied upon as a substitute for independent verification.

Prohibited Use

Unless FanPredikt gives you prior written permission, you agree not to:

1. 01Sell, license, rent, modify, copy, reproduce, download (other than normal browsing), distribute, publicly display, publish, create derivative works from, or otherwise exploit any FanPredikt Data or other FanPredikt intellectual property, or transfer it to any third party;
2. 02Scrape, crawl, harvest, systematically extract, or use bots, scripts, spiders, or similar automated tools or methods to access, collect, or compile FanPredikt Data or any part of the Services;
3. 03Use FanPredikt Data to create, calculate, issue, support, or develop any financial instrument, index, product, or service (including but not limited to derivatives, structured products, or similar instruments) without FanPredikt's express written consent;
4. 04Use FanPredikt Data or any other content from the Services, including associated metadata, to train, develop, or improve any machine learning model, artificial intelligence system, or similar technology, or to generate any output using such a model or system, without FanPredikt's express written consent;
5. 05Reverse-engineer, decompile, or disassemble any part of the Services, or insert any code or product that interferes with or manipulates the Services or another user's experience; or
6. 06Use the Services in any way that violates applicable law or infringes the rights of FanPredikt or any third party.

In addition to the restrictions above, when using the Services you agree not to:

1. 01Cheat, collude with other users, or otherwise attempt to manipulate predictions, leaderboards, rankings, or rewards;
2. 02Create or use more than one account per person, except as we may expressly authorize;
3. 03Use bots, scripts, or other automated means to interact with the Services in place of a real person;
4. 04Harass, abuse, threaten, or impersonate any other person, including other users or FanPredikt staff;
5. 05Upload or transmit anything unlawful, infringing, or harmful; or
6. 06Attempt to gain unauthorized access to the Services, other accounts, or FanPredikt's systems.

We may investigate suspected violations and take any action we consider appropriate, including warning, suspending, or terminating an account, and adjusting or removing points, rankings, or rewards obtained through violations.

If the Services allow you to submit content — such as a username, profile details, comments, or other material ("User Content") — you retain ownership of your User Content, but you grant FanPredikt a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, and distribute your User Content as needed to operate and promote the Services. You're responsible for your User Content and confirm that you have the rights necessary to share it and that it does not violate these Terms or any law.

The Services may contain links to third-party websites or services that FanPredikt does not control. We're not responsible for the content, policies, or practices of any third party, and linking to a third-party site doesn't mean we endorse it. Your use of any third-party site or service is at your own risk and subject to that third party's own terms.

THE SERVICES AND FANPREDIKT DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. FanPredikt does not warrant that the Services will be uninterrupted, secure, or error-free, or that any predictions, odds, or data will be accurate or complete.

FanPredikt is not responsible for technical failures of any kind, including hardware or software failures, lost or unavailable network connections, or incomplete or delayed transmissions, that affect your ability to access or use the Services.

To the fullest extent permitted by law, FanPredikt, its affiliates, and their respective officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Services, even if we've been advised of the possibility of such damages. Because the Services are free to play, our total liability to you for any claim arising from the Services is limited to the greatest extent permitted by applicable law.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the limitations above may not apply to you.

You agree to indemnify and hold harmless FanPredikt and its affiliates, officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

You may stop using the Services and close your account at any time by contacting us at admin@fanpredikt.com. We may suspend or terminate your access to the Services at any time, with or without notice, including if we believe you've violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our discretion. Provisions of these Terms that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will continue to apply.

We may modify, suspend, or discontinue the Services, or any feature of them, at any time. We may also update these Terms from time to time; when we do, we'll revise the "Last Updated" date above and, where changes are significant, provide additional notice such as a notification within the Services. Your continued use of the Services after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, and you consent to that jurisdiction and venue.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision isn't a waiver of that provision. These Terms, together with our Privacy Policy and any other policies referenced in them, constitute the entire agreement between you and FanPredikt regarding the Services. You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
